Terms & Conditions of Sale

1. Acceptance of Terms

These Commercial Terms & Conditions ("Terms") govern all transactions, price quotations, orders, and sales of equipment including submersible pump sets, openwell motors, UPVC column pipes, HDPE pipes, submersible flat cables, motor starters, and borehole accessories conducted by Jain Pumps Marketing (trading as Jain Corporation, 20/1 Maharani Road, Indore, MP).

By requesting a price quote, confirming a purchase order via WhatsApp or phone, or taking physical delivery of merchandise from our Indore showroom or godowns, the buyer agrees to be bound by these commercial terms.

2. Quotations, Pricing & GST

As a wholesale distributor dealing in high-volume industrial and agricultural machinery, our pricing structure is determined by manufacturer list prices and raw material market conditions (e.g. copper, stainless steel, and resin commodity values):

• Quotation Validity: Formal verbal or written quotations are valid for 7 calendar days from the date of issuance unless explicitly stated otherwise.
• GST Taxation: All prices are quoted in Indian Rupees (INR) and are subject to applicable Goods and Services Tax (GST) as mandated by the Government of India (standard 18% or prevailing rate). Official GST tax invoices will be issued for every commercial sale.
• Wholesale Volume Discounting: Special bulk pricing tiers apply to authorized dealers, commercial contractors, and large infrastructure projects based on order volume.

3. Payments & Invoicing

Payment for all purchases must be settled according to agreed commercial terms:

• Accepted Payment Modes: Real-Time Gross Settlement (RTGS), National Electronic Funds Transfer (NEFT), Unified Payments Interface (UPI), Account Payee Cheques (subject to bank clearance prior to goods release), and Showroom Cash settlements within statutory limits.
• Dispatch Clearance: For outstation orders shipped via transport agencies, goods will be dispatched upon receipt of confirmed payment or production of verified bank transaction advice.
• B2B Dealer Credit: Approved regular network dealers may receive revolving credit terms subject to signed commercial credit agreements.

4. Engineering Sizing Advisory & Buyer Responsibility

Our sales team provides technical equipment sizing recommendations (such as matching pump stage and HP to total dynamic head and discharge) in good faith based on the data supplied by the customer or driller:

5. Original Manufacturer Warranty (OEM)

Jain Pumps Marketing distributes 100% genuine, factory-certified products backed by official manufacturer warranties (including Shakti Pumps, CRI, Trueflo by Hindware, G-MAK, Haylong, and others):

• OEM Warranty Terms: Warranty claims are governed strictly by the respective manufacturer's published warranty policy, duration, and conditions.
• Authorized Service Centers: Manufacturer service centers or authorized inspection engineers evaluate warranty claims. Our Indore showroom assists customers with warranty registration and documentation.
• Warranty Exclusions: Manufacturer warranties do not cover damage caused by dry running, operation outside permissible voltage ranges, lack of water cooling, lightning strikes, improper starter overload relay calibration, improper cable joint waterproofing, or mechanical physical damage.

6. Transport, Dispatch & Transit Policy

All wholesale shipments originate on an Ex-Indore Showroom / Godown basis:

1. We coordinate timely drop-offs to the buyer's nominated transport agency in Indore (Transport Nagar, Loha Mandi, Dewas Naka).
2. The transporter's consignment note (Bilty / Lorry Receipt) serves as proof of handover. Consignment bilty copies are shared promptly via WhatsApp or email.
3. Freight charges are payable by the consignee (To-Pay basis) at the destination delivery point unless prepaid by prior commercial arrangement.
4. Buyers desiring transit insurance for high-value pump consignments should specify insurance requirements prior to dispatch.

7. Inspection & Return Policy

To maintain the integrity of our inventory and prevent contamination of factory-sealed equipment:

• 48-Hour Inspection Window: The buyer must inspect goods upon delivery and report any physical transit damage or packing discrepancy within 48 hours of receipt.
• Standard Stock Returns: Unused, uninstalled products in original, unsoiled factory packaging may be returned or exchanged within 7 days subject to prior written approval from our showroom. A restocking fee of up to 10% may apply to cover handling expenses.
• Non-Returnable Items: Custom-cut submersible flat cables, bespoke fabricated column pipes, or pumps that have been lowered into borewells or powered on are non-returnable.

8. Governing Law & Jurisdiction

These Terms and all commercial transactions entered into with Jain Pumps Marketing shall be governed by, construed, and interpreted in accordance with the laws of India. Any legal dispute, arbitration, or proceedings arising out of or connected with these transactions shall fall under the exclusive jurisdiction of the competent courts in Indore, Madhya Pradesh.
